Reading Assignments

For Thursday, 24 August, students should have printed out and read two items, as indicated in class.  First Chevron v. Natural Resources Defense Council, 467 U.S. 837 (1984).  As I indicated in class, this is probably the most fundamental Supreme Court decision relating to administrative agency authority rendered in modern times.  Second, students should obtain a copy of the current Administrative Procedure Act.  This involves a multiplicity of sections of the United States Code (U.S.C.).  "Obtaining" a copy does not necessarily mean reading the entire statute, but students will need to refer to various segments of this statute throughout the semester, both in class and for their Research Project.  These are listed below:

For Tuesday, 29 August., students should read Chapter 1 of Eisner, Worsham, and Ringquist.  We will devote a substantial amount of time several class periods discussing these materials in class.  So by this date students should be able to discuss and outline the material covered in this chapter.


For Thursday, 7 September., students should read Chapter 2 of Eisner, Worsham, and Ringquist.


For Tuesday, 26 September, students should complete the reading of:

  1. 5 U.S.C §§ 553
  2. Their agency's rulemaking procedures, either from the statute or from the C.F.R.
  3. Kerwin, entire
