Assume that the U.S. Supreme Court has granted a Writ of Certiorari to the U.S. Court of Appeals for the Federal Circuit in the case sub nom. Scholl v. U.S., No. 06-2580. Assume the case has been argued before the Supreme Court and is awaiting decision. The lower court opinion in this case is reported in In Re United States, 463 F.3d 1328 (Fed. Cir. 2006).

Write the majority opinion for the Supreme Court, announcing the decision and justifying the decision on the constitutional issues in this case .

The opinion is to be printed on cotton rag content paper, and formatted in the fashion of a Supreme Court opinion. The opinion should deal with all the constitutional issues raised in the case. It is due no later than Tuesday, December 12, 2006, at 3:20 pm. At that time, it may be submitted in the classroom, FRNY B124. It may be submitted earlier than that day and time, but no later.
