POL 462 Final Examination

Spring 2007

Assume you are an Associate Justice of the United States Supreme Court.  (You have made substantial progress over the course of the semester, so now you are on the Supreme Court.) 

Prepare the opinion for the Supreme Court on the constitutional issues in the case of Morse et al. v. Frederick, No. 06-278, argued March 19, 2007.  The legal briefs for the case and the lower court opinion in Frederick v. Morse, 439 F.3d 1114 (9th Cir. 2006) are available online, and you should consult these along with any relevant precedent in preparing your opinion.  Structure the opinion as the Court would with sections and/or headings.

This examination is due not later than at 10:30 AM in LWSN B151 on Thursday, May 3, 2007.  It is to be typed, single-spaced with an extra line space between paragraphs.  Your submission should begin with the case title and other documentary indicators, followed by the line "The Opinion of the Court was delivered by XXXXXX, J."  Put your last name in the XXXXXX space.   The opinion should be stapled in the upper left-hand corner.  Do not use footnotes, but rather string citations in the text for precedent or statutes that you cite in your opinion.  Number all the pages consecutively.
